Why does it cost more if the property is leasehold?
The conveyancing of a leasehold property is more expensive because there is more legal work involved.
Why is the cost of conveyancing linked to the property value?
In certain circumstances the conveyancer can be held liable for problems that occur during the transaction. The conveyancing costs increase in line with the property value to reflect the increased risk and associated indemnity insurance premiums. Furthermore the land registry also operates a sliding scale of fees in accordance with the property value and the quote produced by this website calculates the appropriate fee payable.
How will my case be handled?
Your case will be allocated to an individual who will have conduct of the case. You will be given the individual’s email address and direct dial telephone so you will always communicate with the right person. A fully qualified experienced conveyancing solicitor will deal with the legal aspects of the case and oversee the transaction.
How long will the process take?
This is the most commonly asked question and is simply not possible to answer with any accuracy because every transaction is different. Most sales and purchases take 8 - 12 weeks to complete however it may take less time if it is very straightforward or longer if the property is in a chain, if the property is leasehold or there are any other complications. Leasehold properties always take longer because there are additional requirements and information is required from third parties.
If you have any special requirements or if the seller or buyer in your proposed transaction has imposed a time limit we will be happy to endeavor to accommodate this for no additional cost.
Most remortgages take 4 weeks to complete provided there are no significant complications.
Why does the conveyancing process take so long?
There are a large number of variables that all need to coincide at the right time for completion to take place. This includes (but is not limited to):
- Receipt of satisfactory searches
- Receipt of satisfactory replies to enquiries
- Funding being in place
- Compliance with mortgage offer conditions and mortgage valuation requirements
- All other properties in the chain (if any) must be ready at the same time. The longer the chain the more difficult this becomes
- Leasehold properties take longer as there is more legal work involved
I am currently in rented accommodation. Should I serve notice on my Landlord?
No. You should not serve notice until a firm completion date is known.
Do I need an Energy Performance Certificate?
It is a requirement for all homes to be sold with an Energy Performance Certificate (EPC) which must be ordered before marketing can begin. If you are selling a property and require an EPC please tick the "EPC required" box on the home page.
What if the property is a repossession?
We specialise in dealing with purchases following the repossession of the property.
Most lenders impose deadlines for exchange and completion and we are happy to work towards these deadlines for no additional cost. Because the lenders have no knowledge of the properties they are selling the risk for you is greater because they do not provide the usual information provided by most owner occupiers. We are experts in advising you in these situations. Unlike many firms we do not charge a supplement for dealing with repossession transactions.
What is the conveyancer’s job?
The conveyancer’s job is to make sure the buyer (and lender) get a good and marketable title to the property.
Can the same conveyancer act on behalf of me and my mortgage lender?
Yes.
Can the same conveyancer act on behalf of the buyer and seller?
Not usually however there are exceptions such as family transactions.
What is conveyancing?
